The 242,000-square-meter area is located on Avenida Augusto Barata, between the neighborhoods of Alemoa and Saboó, in Santos; the project for the site includes a truck holding yard for 460 trucks (Alexsander Ferraz/AT) The Federal Court denied the appeal (motion for clarification) filed by the Autoridade Portuária de Santos (APS) and upheld the suspension of the bidding process for the construction of a logistics condominium in the city. The bidding has been on hold since December of last year, following a preliminary injunction granted in favor of the Associação Brasileira dos Terminais de Contêineres (Abratec), which requested the suspension of the process due to objections to the tender notice. There is still no date set for a final ruling in the case. The area comprises 242,000 square meters (m²) and is located on Avenida Augusto Barata, between the neighborhoods of Alemoa and Saboó, in Santos, opposite the terminal operated by Brasil Terminal Portuário (BTP) and the future Tecon Santos 10. The project includes a logistics condominium with a truck holding yard, services, and facilities for drivers’ meals and rest. In its appeal to the Court, the manager of the Santos quay argued that Abratec had “misled the Court by stating that only one participant had taken part in the bidding process” and that “the decision suffered from ambiguity.” These arguments were dismissed by Judge Diogo Henrique Belozo of the 1st Federal Court of Santos in a ruling issued last week. According to Abratec’s director, Caio Morel, the best solution would be to conduct a new bidding process for the use of the area, “allocating the asset to container handling with broad participation of all interested parties, without restrictions, thereby enhancing the value of the property for the public authority.” “The APS bidding process lacked transparency, there was no public participation through public hearings, and the bidding procedure lasted only 15 days, leaving insufficient time for interested parties to assess the investment. It came as a surprise to the sector”, he argues. According to Abratec, the bidding violates the Economic Freedom Law (Law No. 13,874/2019). Published on October 21, with a deadline of November 12, 2025, for submission of documents, the tender received only one proposal considered “derisory,” amounting to R\$ 1.20 per square meter per month for a strategic area of the Port of Santos. On the same day, APS launched two tender notices for the assignment of areas intended for logistics condominiums in Santos and in Guarujá. Proposals were received on December 17, also with a single bidder in each case. Consórcio Portlog won in Santos, and Consórcio Marlog–Petrasalis Logística won in Guarujá. Together, the projects provide for 877 truck spaces, with operations scheduled to begin in 2029. The contracts total R\$ 477.9 million in investments and have a concession term of 20 years. The other side In a statement, APS reports that it has submitted to the court records a recent opinion issued by the Ministério de Portos e Aeroportos (MPor), which substantially reaffirms the information previously provided regarding the offering to the market, and that it is confident this will be duly considered when the 1st Federal Court of Santos issues its decision, which is expected shortly. “The classification of the area as dedicated to port operations would be incorrect and is not what is defined in the Plano de Desenvolvimento e Zoneamento (PDZ) of the Port of Santos. The project area, historically known as ‘Terreno da Rede’ (former RFFSA), is expressly classified in Chapter 2.4 of the 2020 PDZ as Areas and facilities not dedicated to port operations.” The Port Authority defends “the maintenance of the current rules, including competitive safeguards aimed at preventing the formation of vertical monopolies and ensuring that essential access infrastructure to the Port is not captured by a single economic group, to the detriment of other users. The bidding process aims to serve the immediate public interest of organizing truck flow on the Right Bank.” Entities In addition to the lawsuit, Abratec, together with five other industry entities (ABTL, ABTP, Abtra, ATP and Fenop), sent a joint letter to the Ministério de Portos e Aeroportos (MPor) and to the Agência Nacional de Transportes Aquaviários (Antaq) requesting the immediate annulment of the tender notice for the Right Bank condominium. According to APS, with respect to the Left Bank logistics condominium in Guarujá, the result was ratified on January 21, as scheduled. “Consórcio Marlog - Petrasalis Logística now has three months to submit the required documentation to execute the contract”, explains the Port administration.
